Our cidb practice note on Blacklisting Contractors discusses actions that organs of state can take against contractors for non-performance. It concludes that all issues of non-performance on contracts issued by organs of state should first be dealt with in terms of the contractual procedures between the employer and the contractor, and should thereafter be referred to the cidb in terms of a potential breach of the cidb Code of Conduct.
Names of contractors removed from the cidb Register of Contractors
In terms of regulation 30(2) of the Construction Industry Development Regulations, the cidb publishes the particulars of Board findings relating to contractors removed from the cidb Register of Contractors. These removals support the cidb’s commitment to construction industry compliance, procurement integrity and accountability, ensuring that only credible, registered contractors participate in public infrastructure delivery.
Contractors listed have breached the requirements and conditions of registration, including the submission of fraudulent documents, which can affect their ability to tender for and be awarded public sector construction work that requires active cidb registration.
