The cidb Code of Conduct for the Parties engaged in Construction Procurement requires that the parties in any public or private construction-related procurement in their dealings with each other: 

  1. Behave equitably, honestly and transparently.
  2. Discharge duties and obligations timeously and with integrity.
  3. Comply with all applicable legislation and associated regulations.
  4. Satisfy all relevant requirements established in procurement documents.
  5. Avoid conflicts of interest.
  6. Not maliciously or recklessly injure or attempt to injure the reputation of another party.

The published code of conduct contains examples of acceptable and unacceptable actions of the parties engaged in construction procurement.

The Construction Industry Development Board Act, 2000, permits the cidb for the purposes of enforcing the code of conduct, to convene an inquiry into any breach of the code of conduct. In this regard, the cidb may subpoena any person to appear in person at an inquiry, subpoena any person to produce any documentation relevant to such an inquiry, and seize and make copies of the documentation so produced. The cidb may:

  • issue a warning to the accused;
  • reprimand the accused;
  • report the accused to the Auditor-General or the Public Protector or both;
  • impose a fine not exceeding R100 000.00 on the accused; or
  • suspend the accused from participating in public sector procurement for a period of time;

and make a cost determination to defray all or part of the costs incurred to conduct the investigation.
